Refunds

Except when required by law, Donations already received by the Company are non-refundable. Certain refund requests for Donations may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company.

The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors.

The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

You assign all rights, title and interest in any Feedback You provide the Company. Reason For the Policy

In order to benefit from service, the service recipient must understand the relationship between the provider and the recipient. This requires the provider and recipient to discuss the rights and responsibilities of the provider and the recipient in a manner that is compatible with the competency of the recipient. This allows the recipient to make an informed decision whether to use the service, the nature of the service, and the length of service.

Policy

Service recipients will be informed in writing and through discussion, during initial contact of the following rights:

  • The relationship between the individual and the worker will be one of mutual respect with both parties making decisions together.
  • The right to access services that meet personal capabilities and have assistance when access is unavailable due to language, speech, hearing, or any other limitation.
  • The right to be informed of the qualifications of the provider.
  • The right to receive an explanation of the types of services offered, the time commitment and any fees, if applicable.
  • The right to be informed of personal actions that would lead to termination of service.
  • The right to be informed about what personal information is collected, the purpose of collecting the information, and how it will be used. (PIPA)
  • The right to have information treated confidentially and any exceptions required by law to be explained.
  • The right to ask questions about the techniques and strategies used.
  • The right to contribute to a plan and evaluation of service.
  • The responsibility to set and keep appointments and follow through with agreed strategies.
  • The right to view their personal file.
  • The right to request copies of their records or reports or to have these record or reports forwarded to another party.
  • The right to terminate service at any time and/or request a referral to another provider.
  • The right to know the hours of service that are available to them and to be referred to other services when access is delayed.
  • The right to know the procedure for making a complaint.

Procedures

All programs will provide, at time of intake, written and verbal information regarding the service delivery relationship. Material will be in plain language and specific to any special needs of the individual. A package of information for the recipient to retain will be provided. Providers will explain the information and ensure that the recipient is able to make an educated decision regarding the service.

SERVICE RECIPIENT’S RIGHTS FOR CHILDREN & YOUTH

Policy

In accordance with the Federal and Provincial Human Rights Legislation and the United Nation’s Declaration of Children’s Rights, the South Peace Community Resources Society will:

  • Provide all service recipients with all of the rights provided for under these Statutes and Declarations,
  • Ensure that all service recipients are aware of their rights,
  • Ensure that service recipient rights are consistently maintained throughout all Programs and
  • Redress any violation of a service recipient’s rights immediately.

Procedures

The Rights of Service Recipient

The rights of children in care are defined as follows:

  1. The Right to Physical Security and Well-Being Within the Program of SPCRS
  2. The Right to Emotional Support
  3. The Right to The Consistently Best Care Possible
    With respect to care:

    1. Service Plans
      The service recipient has the right to a service plan designed to meet the service recipient’s particular needs, which will be prepared within 30 days of the child’s admission to the Program.
    2. Rights of Care
      The service recipient has the right:

      • Participation
        To participate in the development of the service plan and in any changes to it.

      • Nutrition
        To receive meals that are well-balanced, of good quality and appropriate to the special needs and cultural background of the service recipient.
      • Clothing
        Where the service recipient is reliant on the program for clothing, they are to be provided with clothing that is of good quality and appropriate for the service recipient, given the size and activities and prevailing weather conditions.
      • Medical/Dental Care
        Where the service recipient is reliant on the program for medical/dental care, they are to receive medical and dental care at regular intervals and whenever required, in a community setting whenever possible.
      • Education
        Where appropriate to receive an education, which corresponds to the service recipient’s aptitudes and abilities, in a community setting whenever possible.
      • Recreation/Athletics
        To participate in recreational and athletic activities that are appropriate for the service recipient’s aptitudes and interests, in a community setting whenever possible.

  6. The Right of Access to Knowledge of Self and The World In General
  7. The Right of Access to Responsible Adults
  8. The Right of Access to Responsible Guidance

  12. Rights with Respect to Personal Liberties
    With respect to personal liberties, the service recipient has the right:

    1. Privacy/Personal Possessions
      To have reasonable privacy and possession of his or her own personal property.
    2. Religion
      To receive the religious instruction and participate in the religious activities of his or her choice.

  13. Rights with Respect to Visits
    With respect to visits:

    1. The service recipient has the right to regularly speak in private with, visit and receive visits from members of his or her family regularly, where it is safe to do so.
    2. A service recipient has the right to speak in private with, and receive visits from:

      • The service recipient’s solicitor,
      • Another person representing the service recipient, including an advocate appointed for the service recipient by the appropriate government or judicial body,
      • A member of the Ombudsman’s office,
      • A member of the Legislative assembly or the Government of Canada,
      • A member of City Council,
      • Relatives, or
      • Clergy
  14. Right to Be Heard
    With respect to the right to be heard:

    1. A service recipient has the right to be consulted and to express his or her views, to the extent that is practical given the service recipient’s level of understanding, whenever significant decisions regarding the service recipient are made including:

      • Decisions with respect to medical treatment,
      • Education and religious decisions, and
      • Decisions with respect to the service recipient’s discharge or transfer to another placement.
  15. Right to Be Informed
    With respect to the right to be informed:

    1. The service recipient has the right to be informed, in a language suitable for the service recipient’s level of understanding, of the following:

      • The rights of the service recipient,
      • The service recipient’s responsibilities within the Program and the facilities,
      • The rules governing the day-to-day operations of the Program, including disciplinary procedures, and
      • The internal complaints procedure of the Program.
  16. Rights with Respect to Mail
    With respect to mail:

    1. The service recipient has the right to send and receive mail that is not read, examined or censored by another person, subject to the specific provisions described immediately below.

    2. Mail to a service recipient:

      • Will not be examined or read by the service provider, or a member of the service provider’s staff, if it is to or from the service recipient’s solicitor,
      • Will not be censored or withheld from the service representative, except that articles prohibited by the service provider may be removed from the mail and withheld from the service recipient,
      • May be opened by the service provider, or a member of the service provider’s staff, in the service recipient’s presence and may be:
      • Inspected for articles prohibited by the service provider or,
      • Examined and read where the service provider believes, on reasonable grounds, that the contents of the mail may cause the service recipient emotional or physical harm.
  17. Rights to Refuse Service:

    1. The service recipient has the right to refuse any and/or all services, treatments or medications unless those rights have been limited by law or court order.

    2. The service recipient has the right to be informed of all limitations of rights and the consequences of any refusals to comply with legal limitations or court order.
